Important Questions


Abducted policemen released. Is it a victory for anyone?

All police person kidnapped by Maoists have been released. It is good news indeed. It is relief for family of abducted police men. It is relief for Government. But it should not be treated as victory of CM Mr. Nitish or any mediator. It should only be taken as a lesson to learn, both for state and central government. It is not too late even now that all political parties come together and jointly plan strategy to fight and finish naxals from the root. Talking with those who do not believe in rule of law is nothing but ridiculous and self deceptive.

Advising naxals to contest election is useful or simply a joke?

Members of Parliament or those of state assemblies are growing richer but the poor and innocent voters are growing poorer year after year. Pain of common men is seldom taken into consideration by these elected members. As such it will be great foolishness to say that taking part in election or winning a seat by naxals will solve the real problem. So far as naxals are concerned they are least bothered of Indians, Indian rules and Indian Constitution and hence advising them to contest election is also filled with danger.


Rahul’s rally in Bihar?

People of Bihar in particular and Indians in general are worried of police person kidnapped and made hostage by naxalites. But Rahul Gandhi is making efforts through rally in Bihar to gain political advantage out of this crisis as traditionally and consistently congress party has been trying to gain advantage on Kandhar episode. Congress party forgets 1984 Sikh Riot, Godhra incidents but cannot forget to trap Narendra Modi for fake encounter or post Godhra riot in Gujarat. Even media do not hesitate in supporting Congress party in this exercise even if it divides the society and cause threat to national unity and integrity.



Why Non –BJP parties hate Narendra Modi?

Congress party is accused of killing Sikhs in larger number in 1984.It cannot blame Narendra Modi. Anyway the main reason for the hate against Narendra Modi is that ruling politicians at centre want to weaken BJP by hook or by crook and media support it to a great extent. Modi is strong men who cannot be swayed by pseudo secularist. Fate of not only BJP but also that of the country depends on person like Modi and not like Mammohan Singh who being an greatest economist of India could not do anything better than what Modi, a simple but effective and devoted person could do for Gujarat.

Should cricket game be banned?

In my opinion Pakistan should now ban cricket and save loss on energy on game like cricket. Cricketers are accumulating wealth at the cost of national image. Cricketers are playing with sentiments of fans of cricket and viewers of cricket match. India should also learn lesson from what is going on in all types of game, IPL or CWG or 20-20 or normal test matches.


Strike Today?

All India strike call has been given by some trade unions on 7th of September 2010. Pioneer among them re communists led parties and trade union wings. Communists are almost out of power. There is no scope of power in future in West Bengal or Kerala. Tripura government may continue for some time. In such position strike is the only weapon in their hand to keep their workers active and loyal to the party.

Communists have spoiled labour culture and forced many private or public sector companies to close the business to get rid of dadagiri of communists at various places. Left parties were in power indirectly with UPA at centre from 2004 to 2009 but their work was either to criticize UPA or put hurdle in the path of decision making process initiated by UPA on any critical issue. As such the strike of today will have no moral support from any common man or bank employee or trader.

No doubt issues raised are very much genuine and cause of concern for common men. Price rise has hurt the common men most in last two years .Privatization and globalization without taking care of poor and middle class people has only helped rich in growing richer and also in widening the gap between the poor and the rich. Social injustice has increased and hence social peace is disturbed. GDP growth is said to be consistent or increasing year after year but the so called growth is confined for a few percentage say less than 5% population of the country.

Misuse of Court

( An Open appeal to Prime Minster of India and Finance Minister of India)

Subject: Illegal recovery from PF optees in PSU Banks
And
Misuse of usual delay in judicial process

I would like to draw your kind intervention in the matter of second offer of pension being given to bank employees who did not accept pension offer in 1993/95 when pension scheme was first introduced in banks in lieu of contributory provident fund.
After prolonged movement by bank employees for almost 15 years and after 30 months agitational programme, Indian banks Association (IBA) signed an agreement with United Forum of Bank Employees (UFBU) on 27th of April. Till 25th of April 2010 there was never a talk among leaders during last 15 years that there will be recovery from PF optees from their arrear if they are given second option for pension. But in the eleventh hour, union leaders who are mostly retired employees were ill motivated by IBA and it is they played a mischievous role to introduce a discriminatory clause in the agreement which enables banks to recover 2.8 times of revised salary of November 2007 from such employees who opts for pension.

Obviously those who opted for pension in 1993/95 got free option for pension whereas those who will opt for the same benefit after 15 years prolonged movement will have to purchase the same by paying Rs.50000 to more than one lac rupees. This discrimination is clearly in violation of spirit of Equality of Law granted under Indian Constitution.

Since the agreement was signed by a few say 20 union leaders on behalf of eight lac bank employees IBA got an upper hand in executing even legally invalid clause. In such position bank employees all over the country started condemning the said bipartite settlement, formed fresh unions and finally filed writs in various high courts.

On 24th June 2010 Madras High Court granted interim stay on recovery from PF optees.

But IBA and bank management in nexus with mischievous union leaders filed another writ in the same court for vacation on stay on the false but emotional plea that retired employees are on the verge of death and banks are unable to start pension payment to them because they have no fund and they not got refund from retired employees.

Court due to its busy schedule heard the petition on 10th of August 2010, considered the pain of retired employees and vacated the stay.

IBA and union leaders in particular and people of India understand it very well that once the court case is filed in any Indian court, it will take a decade or two decade in getting final judgment on any issue. In such situation banks can execute the disputed agreement.

It is open secret now that banks will not only spend lavishly on advocate to prolong the hearing , torture the fighting employees and but also try its best to weaken the fighting intensity of employees who have moved courts in the large interest of three lac retired and three lac serving employees.

Obviously bank employees for none of their fault will have to pay Rs.50000/ to more than one lac to purchase pension offer which is absolutely illegal and not reasonable from any angle of consideration. Such discriminatory recovery never occurred in any department in our country. This historic blunder is going to be committed by bank management and bank employees will become victim of faulty judicial process as everyone knows that it takes High courts and Supreme Court two to three decades in deciding any case.

I therefore make an earnest appeal to you to advise finance ministry, banking division, law ministry and IBA to bring about necessary change in the agreement or else government of India should promulgate an ordinance and make bank employees at par with Central government employees and nullify the said discriminatory agreement. In the recent past when dispute arose between IRDA and SEBI government of India with the help of ordinance nullified the effect of court case filed by IRDA against SEBI.

Alternately you can ensure expeditious judicial process by appointing special bench in Supreme Court combining writs filed at various High courts to decide the issues of writ in fixed time frame of 30 days. .

It is the most disheartening and sad story of Indian judicial system that courts are used in general and in practice not to get justice but to perpetuate reign of injustice. Courts seldom award punishment to guilty person in time but spend so much time in the process of judgment that the victim is either extinguished or the very purpose of filing a case is defeated or loses physical, mental and financial energy to such a pitiable extent that the case filed for justice is ultimately left unattended and become useless and endless. Even the veteran criminals get relief once the police files case in any court. It is very easy to prolong the judicial process as per whims and fancies of the criminal and at least till all witnesses or all plaintiffs are finished or become ineffective.

For your ready reference and to enlighten you more on the subject I submit hereunder some important points related to pension rules and subsequent agreement prevalent in banks.

1. In the Pension Regulations 1993/1995 there is no provision for collecting money from employees to make up the short-fall in pension fund. If at all any short fall is faced it should be made good by the banks themselves. Then on what basis banks are now asking employees to contribute for short fall?

2. In 7th, 8th, 9th bi-partite settlements 8.25%, 9.25%, 13% of additional cost of pension was carved out of wage load and given to banks to make-up the shortfall in pension fund. This amount belongs to both Pension Optees and PF optees, but used for paying pension to Pension Optees only. Therefore is there any logic in asking funds now from PF optees only?

3. In the Pension Regulation 1993/1995 there was a clause stating that pension will not be paid to those employees who participates in any strike. In 1999, this clause has been removed, but no fresh option is given to PF optees to join pension scheme then. Why?

4. In Railways and RBI fresh options were given to employees to join Pension Scheme several times without asking single paisa. Then why in Banks, Employees are asked to contribute towards Pension Fund?

5. If all the employees would have opted for Pension in 1996/1995 itself, how banks would have managed Pension Fund?

6. In State Bank of India three retirement benefits are being given to employees. viz. PF+Pension+Gratuity. In Public Sector Banks only two benefits are available. Even for that second benefit Employees have to pay in every wage revision settlement. Does it mean Bank Employees are not given two retirement benefit, but they are given only 1.5 benefits i.e., half of what SBI employees are getting?

7. When SBI associate banks are merged with SBI, Govt. is ready to extend Pension Benefit to those Employees of associate banks without asking anything from employees. Where from money comes to meet this additional expenditure?

8. Banks are ready to incur expenditure to the extent of 14% (10% of B.P. +D.A) towards PF for new recruits from 01.04.2010, but not ready to pay more than 10% for PF optees. Why?

9. Pension Regulation 1993/1995 provides for paying pension only on superannuation, i.e. after 60years of age only, but at the time of VRS2000 it is modified /amended to give pension to even employee of 40years. Because of this act of Banks only, Pension fund dried up. Is it not true?

10. Hence, we PF optees feel principle of natural Justice is denied to us and it is clear cut violation of fundamental Law of Equality before justice granted by Constitution of India to each citizen of India.

I am fully confident you will take all possible steps to give justice to six lac bank employees who have been badly affected by said agreement. It is worthwhile to mention here that bank management has already recovered Rs.1800 crores from serving employees who will be given second offer for pension as per said Agreement. Not only this , even trade unions participating in the said agreement has realized more than two hundred crores from bank employees as Levy or their remuneration or fee for negotiating with IBA and for signing on the said agreement.

National Issues Points causing concern to all

PM is not active and effective as people of India expect from him. It may be the issue of price rise, corruption or lack of basic amenities infra structure for common men or the threat of naxalism and terrorism to common men. He talks of only GDP growth which means Garibi Development Programme. Rich people are growing richer. He gives relief of Interest to Industrialists and real estate developers but do not think it wise to care for senior citizens whose survival depends on interest income. I like to pinpoint following national issues.

State level inertness or ineffective central government or anger of God has made te situation a point of concern for all ministers in Government.

Kashmir: Curfew continues for last fifteen days due to violent agitation and uncontrollable destruction of property carried out by Kashmiri militants instigated by Pakistani terrorist. Kasmir is boiling and people are facing war like situation but PM is talking of peace since he took the charge of PM

Kolkata West Bengal: Naxalites attacks trains and local inhabitants. Mamta organised rally at Lalgarh along wit naxals and she without any hesitation is putting pressure on central government to stop Green hunt operation launched by P Chidambram Home Minister merely to disturb West Bengal Government.

Chhatishgarh : Naxals attacks frequently on CRPF jawans and kills hundreds of them in Dantewara.

Ahmadabad in Gujrat and Badmer in Rajasthan: Nature is destroying property worth hundreds of crores of rupees and giving trouble to lacs of residents and bent upon destroying property worth crores of rupees in Ahmadabad and other towns by way of flood. But action for giving relief is very low from te side of government.

Madhya Pradesh and Gujarat: IAS officers are trapped by CBI and Anti Corruption Bureau who were found to possess property worth hundreds of crores of rupees and government is not in a position to punish even IAS officers and IPS officers. There are more than 150 officers and more than 100 bank executives and a good number of PSU heads cases of corruption pending for investigation and punishment with CBI either in want of enough manpower to pursue the case expeditiously or under pressure of VIPs of government.

Bihar: CM is accused of involved in misuse of development fund worth 11000 crores. Train dacoity and misbehave with passengers have become a common feature. Frequent train accident due to negligence is a matter of concern.

Jharkhand: Madhu Koda trapped in playing with government fund involving hundred of crores of rupees. Frequent bunds called by naxal organizations have fully disturbed and paralyzed normal life in the state of Jharkhand, Orrisa, West Bengal and Andhra Pradesh.

Karnataka: Reddy brothers are accused of indulged in illegal mining causing loss of hundreds of crores of rupees to government of Andhra Pradesh.

Kerala : Church and CPM are crying against each other.

Delhi: Suresh Kalmadi playing Corrupt Wealth Game allegedly causing loss of thousands of crores of rupees to government. National pride and national image is getting tarnished in International forum. India is likely to acquire number one position among list of most corrupt nations of the world. Magnitude of corruption is in no case less than annual March Mahaloot occurring in the country in every state.

Uttar Pradesh: Food grain worth crores of rupees damaged in want of proper storage facilities to store food grain items procured by farmers.

Madras Tamilnadu: Indian Bank Association in collusion with union leaders cheated PF optees of PSU banks by signing discriminatory and illegal 9th Bipartite Settlement with union leaders of bank. Madras High court stayed the recovery from PF optees but IBA is bent upon making recovery without giving offer for pension to eligible PF optees as per settlement.

Mumbai Maharashtra: Two big ships collided in Arabian Sea and there is fear of hundreds of oil tankers drawn into see and cause loss to environment, loss of sea birds and poisoning of water. No steps appear to have been taken to stop damage.

Leh : Cloud burst kills hundreds of person and destroys property worth crores of rupees.


National Issues causing concern in India: Common men in the entire country are facing pain of unbridled and unabated price rise in all essential commodities. And government of India is finding it difficult to control the same. Mutual blame game between state government and central government continues since long and people of India are silently bearing the brunt of price rise.

Corruption in centrally sponsored programme namely NREGA has beaten all past record of corruption.

Lacs of cases are pending in various courts in India in want of enough manpower, adequate infra structure and required number of judges. Judicial reform promised by various governments during last two decades is not moving in right direction of achieving the desired success

Education reforms promised and propagated by Kapil Sibal are yet to see rays of success and there is remote possibility of getting any considerable any reformation in education system. Tuition fee charges by schools, colleges, medical colleges and engineering institutes are still beyond the rich of common men.

Quantum of Non Performing Assets in banks is growing rapidly because there is no full proof method of recovering money from willful defaulters. Bank managements therefore hide NPAs to show higher profit. This has taken the shape of incurable cancer

Indian borders are still not having watertight security and due to this infiltration of terrorists in India from across the border continues unabated. Buses going outside India or vehicles plying in border areas are prone to security lapses due to negligent attitude of customer officials entrusted with the duty of checking the passengers..

Labour laws are yet to be reformed. Discrimination in various fields continues unabated.

Adulteration in food grain items is increasing rapidly, fake drugs and medicines are in circulation, fake notes are coming in market in large quantity, accidents are increasing, crime is increasing but police is still inactive and criminal friendly.

It is pity that above mentioned problems are not taken as a problem by government. MPs and MLAs are playing Kabaddi in Parliament and state Assemblies. Various parties are indulged in mutual blame game and they focus on strategy to win the election and not to give relief to common men.

I desire to place following questions before Banking Division, Ministry of Finance, Prime Minister of India, President of India and all trade Union Leaders in banks. I hope you will give due place for this appeal which will serve the purpose of lacs of bank employees.

QUESTION EVERYTHING!....SAID SOCRATES! WE THE PF OPTEES QUESTION THE PENSION SETTLEMENT!

Prime Minister, Finance Minister, President of India all are silent

How many Banks have obeyed the stay order of Madras High Court and not recovered 2.8 times of November 2007 salary from PF optees?

How many banks have not yet started paying arrears as per 9th BPS.?

How many banks have issued pension offer till date and if not why have they recovered from PF optees? Already three months are likely to complete after the date of settlement. Why bank is so slow on the issue of pension offer and so fast on the matter of recovery and similarly why union leaders are so anxious on recovery of levy of Rs.3000/ from their members and not worried for delay in offer of pension? Union leaders are getting farewell gift of five lacs or ten lacs on their retirement from Union Fund. Is this the way to use hard earned contribution made to Unions and Associations by poorly paid bank employees?

Days are not far when union leaders will distribute accumulated union levy amounting to hundreds of crores of rupees among themselves and ask for separate fee if they fight for any aggrieved employee. Are union leaders not more dangerous than our management bosses? I say this because union leaders have threatened to expel officer from their association if they do not pay union levy of Rs.3000/ on account of so called successful historic agreement. Management never dared to issue dismissal threatening to officer employee if they fail to obey any instruction of boss.

Why are employees keeping mum on illegitimate recovery and bent upon getting arrear at the earliest even if it is discriminatory? Why are they afraid of even lodging their protest before accepting arrear payment?

Bank management has signed a historic victory agreement when they have vertically divided the employees in two segments and created an unbridgeable split in banking unity and created dilution in their intensity to fight against the reign of injustice perpetuated by management.

And Bank union leaders on the contrary has committed a historic blunder by signing a discriminatory and divisive agreement on 27.04.2010 for some or the other vested interest and clearly betrayed the cause of unity for which they used to struggle under the banner of communist parties.

At least pension optees are now in support of the agreement. It hardly matters to most of them how loudly PF optees cries and weeps though in the past they all always used to be on the same platform and UFBU was also formed for the same purpose. Banking unity was an example in the community of labour class or working class.

Banks are not in the grip of flatterers. Those who are yes-men are getting timely promotion and getting best posting and in this way a team of flatterers are generated by bank management who blindly support of all action of the management right or wrong. Even union leaders do not fight against such lollipop like promotions and transfers because they say that ultimately their members are getting promotions and cream posting or choice posting though the same may be at the cost of others genuine right. At least veteran union leaders are enjoying posting in Metros and capital towns, they need not perform bank’s job, they may do their side business, they may take share from dirty dealings in credit decision or contract offers corruption and they may get sweet request from corrupt officers for reduction of punishment and so on. Lastly they may get huge gifts from top branch managers, big bribe earners, big customers and last but not the least huge money from union fund on their retirement and on attending an inquiry from Union Fund. Similarly union leaders now plead that the said agreement is good in the light of social security though they know and understand from the core of their heart that recovery from PF optees is not justified from any angle of consideration.

This is called divide and rule policy. Intelligent, talented, experienced, valued and visionary leaders of bank management who occupy the important seats of core committee of IBM as also that of United Forum of Bank Unions are very well aware and they all realize from the core of their heart that injustice has occurred with PF optees, retirees and those who have resigned. They all know very well that courts cannot deliver justice in decades and decades and this is why they are least bothered of courts also. They have gained sufficient experience by giving undue promotions to even charge sheeted officers and by rejecting even good officers. In every circular enlisting name of officers getting promotion they used to mention “subject to court decisions on various writs going on in various courts”

In the same way IBA is bent upon making recovery from PF optees subject to court decisions. But at the same time God knows whether they will issue pension offer or not. Reason for not issuing pension offer, bank will say they are waiting decision from courts. It is not surprising at least for me that even so called union leaders are also keeping mum on this matter for which they feel proud and say that the agreement is historic.

IBA adopts Divide and Rule Policy to control Bank employees

This refers to 9th bipartite settlement signed by Banks and Trade union leaders of bank employees on 27th April 2010 which contains a lot of divisive and discriminatory clauses. Writs have been filed in various high courts against the said settlement and Madras High Court has even granted interim stay on illegal and unjustified recovery from PF opteees who have been given a second chance to switch over to pension optees segment of employees in the said agreement. Contesting defendants in the court called as AIBEA or AIBOC have filed an affidavit that they represent majority of employees and tried to justify the disputed clause on this plea.

Are AIBEA or AIBOC representing 90% of employees entitled to introduce any whimsical clause in Bipartite Settlement, frame any whimsical policy or sign any illegal agreement even if it violates the existing book of laws, spirit of the Constitution, fundamental right of equality before law?

It appears to me as if majority of employees have empowered union leaders to do whatever suits to them. This is why they are negotiating with the management on posting, transfer of their friends, relatives, and flatterers, reducing punishment of their corrupt colleagues and similarly recommending promotion of officers through members of Interview panel. Union leaders are godfather of 90% of employees and hence they are blackmailing with the management on waiver of big loans and taking their share in the cake. They are all in all for majority of employees and hence they have shut their eyes on manipulation carried out by the management in balance sheets, turned their blind eyes on shortage of manpower in branches, whimsical transfers of a good number of good officers to remote places , prevailing corrupt practices in loans and advances, rampant corruption in contractual works undertaken by banks to open branches, ATMs or in renovation work, transfer of employees, promotion of employees and so on..........................

But court do not consider this fact whether a union represents 90 % of employee or 9% of employees. Even if one person is cheated by bank management, court is not supposed to accept the logic of Trade Union leaders only because they represent majority of employees. Indian courts are not guided by heard of sheep. Courts decide the matter on the merit of the issue and not on the number of persons supporting the issue. Court test the issue from the angle of existing laws and not on he basis of momentum of crown backing the issue.

Late Indira Gandhi changed the basic structure of Indian Constitution in perhaps 1976 when her own vested interest was defeated by her opponent Raj Narayan and when she thought that her post of Prime Minister was at risk. She imposed emergency and promoted all types of excesses through her flatterers. Even bachelors were forced to pass through family planning operation. No doubt Indira Gandhi perpetuated her reign of injustice for a year or two because she was in power and a team of flatterers was backing her.
But the anger of victim people aggravated and turned into a movement against her. With the support of leadership of Jai Prakash Narayan she was removed, she was defeated in the election, she had to face huge humiliation and at a later date even the Apex court set aside the 42nd amendment.

Similarly reign of injustice will prevail in banking industry as long as our protectors are corrupt and the so called trade union leaders in disguise of saviors are working in nexus with top officials of management for their self interest. Reign of injustice is continuing uninterrupted only because it takes two or three decades in getting judgment from Indian courts. Whimsical transfers and arbitrary promotions are taking place year after year only because top officials know that the victim cannot go to court for justice in fear of high cost and repercussion from the bank management.

But they should keep in mind that days are not far when three lac employees called as PF optees who are the greatest sufferer of the said Bipartite Settlement will turn the tide against the management and the so called leaders of Tread unions too.

Rules are made for justice and they cannot be violated by a crowd of miscreants only because they represent majority of residents in the locality. A group of flatterers cannot be allowed to hijack the laws of land only because they are in power or they represent majority of employees.

Last but not the least, It will not be exaggeration to say that this team of flatterers will not only break the heart of true workers in the banking industry but will also badly affect the health of bank, intrinsic value of the bank, demotivate the work force and what not.......

Team of flatterers has committed a historic blunder in the said Bipartite Settlement and they will never be excused by any law abiding person. Divisive and discriminatory approach of such flatterers will be exposed sooner or later.

"Asli Chehra" - TRUE FACE OF BANK UNIONS
Immediately after the settlement, most of the unions patted their back for the so called "historic settlement". Slowly as they started facing volley of questions from the members, they came out with various theories to justify their action, which included the so called legal opinion and IBA's stiff attitude which forced them to agree to recovery from only PF optees to the tune of 2.8 times of the November 2007 pay. An impression was being created by them as if they were not in favour the same till 26th April, 2010, but somehow they were cornered so much that they had to agree to the terms set by IBA. If that would have been the case, then they would not now oppose the petition pending in Madras High Court. That shows the double standards.
But soon the bankers will be able to see the "Asli Chehra" (i.e. True Face) of these union leaders. These union leaders will now not be able to beat around the bush and befool the members by shedding crocodile tears. They have to take a stand in the Madras High Court, as to whether they are in favour of payment by all employees / officers @ 1.6 times or they favour 2.8 times only from PF optees. Some of these unions have already been exposed. Let us see what does the market reports say as at the end of June, 2010.
It is reported that during the course of hearing of the case at Madras High Court, while opposing the interim stay granted by Madras High Court, advocates of IBA, and AIBEA and NCBE, requested for vacation of the stay. AIBEA and NCBE were represented by one of the top most firm namely M/s Aiyar & Dolia and wanted vacation of the interim stay on recovery of 2.8 times only from PF optees to be vacated. So the stands of these two unions are very clear now. They will be using the members’ funds (including PF optees) for payment to the law firms and fighting case against them. However, the Hon’ble Judge advised them to file their counter affidavits and Ordered continuation of the Stay Order. Next hearing has been fixed for 6th July 2010.
Vide circular No. 98 dated 29th June, 2010. AIBOC has declared "We are in constant touch with the IBA and the Convenor of UFBU, to initiate appropriate steps to vacate the stay, at the earliest, to enable IBA to issue necessary instructions to member Banks on the Pension offer". Thus, AIBOC is also likely to oppose the move and appears to be in favour of payment by only PF optees".
(Remember, the stay is not against the Pension offer or issuing circular by IBA, it is only against immediate recovery of 2.8 times of pay of November, 2007 from PF optees. )
The stand of other unions will also be clear within a week, as court in its orders says ""Notice to respondents returnable by 06.07.2010. There shall be an interim order of stay". (all major unions are respondents in this case). The reports indicate that NOBW may support the petition filed by Canara Bank Workers Unions. Similarly, BEFI may not oppose the petition of Canara Bank Workers union. The protest by INBEF has already been incorporated in the affidavit filed in the Court.
If the above reports are true, then 29th June 2010 would be regarded as a sad day in the history of trade union movement of Banking Industry. Souls of great leaders like Parawana Ji would be feeling really sad and dejected.
Till now they have been propagating that they have been forced by the circumstances and situation to accept contributory pension scheme in banking industry. They are giving so many logics and have been pleading as to why they could not make IBA agree to the Pension Scheme in its original form of 1993. We are unable to find any logical reason from Unions wherein it joined hands with the union of the Management i.e. IBA to defeat the efforts of bank employees.

TESTING TIME IS NOT FAR WAY NOW. NOW THESE UNION LEADERS WILL NOT BE ABLE TO SAY THAT IBA DID NOT LET THEM SUFFICIENT TIME AND CORNERED THEM SO SUCH THAT THEY SIGNED THE SETTLEMENT ON 27TH APRIL, 2010. THEY HAVE SUFFICIENT TIME OF OVER A WEEK TO DECIDE WHETHER THEY WANT TO PROTECT THE INTERESTS OF PF OPTEES OR WANT TO DO WHAT IBA IS SAYING.
It has also been reported that some Banks have issued strict instructions for payment of arrears to all the employees / officers by 30th June, 2010 or so, after keeping 2.8 times of the pay of November, 2007 in suspense account. This clearly gives an indication that banks are in a hurry to pay arrears so that they can deduct 2.8 times from the arrears of PF optees before orders of Madras High Court are delivered to them through IBA. In court they will take the plea that notice of stay was not received by them and arrears have already been paid. As Canara Bank has also rushed to pay the arrears today after keeping the 2.8 recovery in suspense, Canara Bank Workers Union is likely to give a strong protest letter on 1st July, 2010 at their Head Office. Canara Bank Workers Union has informed that they are proceeding to Bangalore to personally handover the letter along with a copy of the court order and get the acknowledgement.
Now all the bankers have to take a final call as to whether these union leaders are with the workers or are working against them. We know it is a difficult task as they have to eat their own words. They have issued number of circulars justifying as to why and how they were cornered to agree this changed stand on the night of 26th and 27th April, 2010. However, this is the time when they can correct the mistakes as PF optees have shared the burden of pension even in the last two Bipartite settlements (7th and 8th). This information is now shared by almost everybody (which was not known earlier to 99% of the PF optees).
The unions opposing the petition will be spending lacs of rupees in the legal battle. All this money can be saved if they simple say that we do not oppose the petition and are in favour of the same.
LET PF OPTEES DECLARE THAT THEY WILL QUITE THEIR UNION (WHICHEVER IT MAY BE) IF THEIR UNION OPPOSES THE PETITION FILED BY CANARA BANK WORKERS UNION AT MADRAS HIGH COURT. LET COURT DECIDE THE CASE ON MERITS.

UPDATE ON THE ORDERS ISSUED BY VARIOUS HIGH COURTS AGAINST RECOVERY OF 2.8 TIMES OF NOVEMBER 2007 PAY
In order to ventilate the grievances of the employees, Writ Petitions have been filed in various Hon’ble High Courts.
(A)The First Writ Petition was filed before the Hon’ble Andhra High Court bearing number Writ Petition No. 8237 of 2010 where in Hon’ble Court has passed following orders:
“ORDER: Interim order dated 13-04-2010, to continue, subject to final orders to be passed in this WPMP. Any settlement also, shall be subject to final orders in this WPMP.
Post after Summer Vacation, 2010.”
(B) Writ Petition No. (C) No.3729/2010 has been filed before Hon’ble Delhi High Court, where Hon’ble Court has passed following Orders on 28.05.2010:
“Issue notice to the respondents to show cause as to why rule nisi
be not issued, returnable on 30.07.2010. Necessary steps be taken within seven
days.”
(C) Subsequently, Division Bench of Hon’ble Allahabad High Court while disposing Special Appeal No. 947 of 2010 passed following orders Orders:
“Issue notice.
Respondents are allowed three weeks time to file counter
Affidavit.
List thereafter”

(D) And now recently a Writ Petition bearing no. WP 12269/2010 has been filed before Hon’ble High Court of Judicature at Madras, in the matter of Clause No. 32 of the industry level Wage Revision Settlement dated 27.04.2010 and also clause (1) of the Pension Settlement of even date, seeking a direction from the Hon’ble Court to quash the above clauses only in so far as the said clauses require the provident fund optees now in service to contribute 2.8 times of the Nov 2007 revised pay, if they want to opt for the pension scheme.
Hon’ble Justice K Venkataraman, who heard the matter has ordered an interim stay and the next date of hearing, has been fixed on 06 July 2010. A copy of this order is enclosed.
From what is stated here in above, it is evidently clear that Clause 32 of Settlement dated 27.04.2010 and Clause (1) of Pension Settlement dated 27.04.2010 has become subject matter of judicial scrutiny by the Hon’ble Courts and Hon’ble Madras High Court has passed orders to stay the operation of these clauses.

Why do banks need capital infusion year after year

Government is constrained to infuse capital in PSU banks year after year to salvage sinking banks or to boost up their capital adequacy ratio. Even World Bank is contemplating to infuse capital in selected banks in India to strengthen these banks. This reveals that PSU banks are actually growing weakness year after year and their balance sheets are nothing but result of window dressing in the style similar to which Satyam Computers applied to boost up image of the company.

PSU Banks are facing continuous erosion in their capital due to dirty policies of the government, politically motivated steps taken by the government and constraint in implementation of good policies. Inter bank interest rate competition, waiver of loan culture, financing based on political compulsions, constraints in recovery of loan from willful defaulters, undue delay in legal proceedings in want of proper judicial reforms, unhealthy HRD policies resulting in promotion of corrupt officers and demotivation of good officers etc are a few reasons which are causing great loss to banks and which has made the bank’s health poor and ultimately which forces government to infuse capital in banks.

It is to be noted here that when politicians take advantage of public money held in banks by resorting to loan melas or waiver of loan culture, bankers take it easy while lending to public. Bankers too do not hesitate in lending to improper companies and individuals with doubtful integrity just for their personal gain. There is no doubt bankers have inculcated wrong practices of flattery in banks. Executives, Branch heads, Regional Heads, Zonal Heads, EDs, CMDs focus on their personal status , personal earning by way of underhand dealings and indulge in flattery to their bosses, ministers, officers in banking divisions. They do not hesitate in taking malafide decisions just to please their bosses. Financing to wrong persons and taking gifts or money in return has become a common feature in banks at all levels.

If bankers do not earn illegal money they cannot please their bosses, government offices and even their juniors. Such honest officers cannot dream of promotion and good posting. As such earning money in credit delivery and sharing the same with bosses has become inevitable for survival in banks with dignity. Those officers who are not versed in this tact or modern art of survival or those who protest wrong financing are either posted at remote places or punished. Such genuinely loyal officers can never imagine of promotion or good posting. This is the main reason that bank officers holding key posts indulge in corrupt practice without caring for health of bank’s assets and this is the reason that intrinsic health of banks in general is not sound and banks always need financial support from government to survive.

But the million dollar question is who will bell the cat when Charter Accountant, officers working in rating agencies, officers in vigilance departments, officers working in bank’s own audit offices, advocates, key regulators all are birds of same feather.

judicial reform and Anderson on Bhopal Gas tragedy

It is not only Anderson only, but all VIP culprits are ignored and freed from clutches of all laws of land. Flatterers in all offices are invariably promoted and given respectable position. Posting and posting also works as promotion and on the contrary promotion sometimes acts as a demotivator. When all flatterers are holding top post anything can be managed on phone and ministers do not required to come in picture. One telephonic call is enough to make or mar one's career and hence every right or wrong instruction from boss is carried out by juniors easily even at the cost of lives of innocent people or safety, security, unity and integrity or even pride of the nation. This is why that even after lapse of 25 years, culprits of Sikh Riots of 1984 and Bhopal Gas Tragedy of 1984 are still roaming free. None of VIPs who were actually master mind in the greatest scam and scandal could be punished; it may be Bofors case, Chara scam, Ruchika-Rathore case stock scam UTI ghotala, stamp scam or any small case of fraud or misuse of HRD policies perpetuated at low level. It is ironical that good persons are made victim for ill works of bad person, it is the saddest part of Indian administration and Indian politics. When courts are incapable and dishonest, the scope of even justice from judiciary cannot be dreamt of.

It is not the systemic failure but it is the system prevalent in India. In India corrupt person get priority in all fields and honest and devoted workers are shunted out or placed at a critical and difficult place. Extradition of Anderson demanded by few politicians is not going to serve any purpose other than an attempt to befool Indian citizen once again. Political parties are blaming each other but none of them appears to be seriously sympathetic towards the pain of common men. We live in a country which is for rich people, by rich people and of rich people. It is rich man’s democracy

Rich and influential people delay the proceeding of court as much as possible to avoid decision and eliminate witnesses so that the case may become weak and ineffective. CBI more often than not weaken the presentation of the case when they get enough gifts in either cash or in kinds from the culprit or they get enough pressure from heavy weights ruling the country. In all big cases of political scam or administrative corruption or any scandal two and three decades are wasted in judicial proceedings in a very easy way and in a very casual and normal way. Indian courts usually deliver justice after two three decades. As such Bhopal gas judgment does not appear that much astonishing in India.

No doubt foreigners laugh at Indian style of functioning in all sphere and fate of big cases involving VIPs of the country. Such cases are either languishing in courts for last two or three decades or in such cases, actual culprits are acquitted or lightly punished.

Even Law minister shamelessly accepts that the justice is not only delayed but buried. Judgment on Bhopal Gas mishap has made it more crystal clear that any Indian cannot expect justice from Indian court until he has money and muscle power to build pressure on advocates and judges. And persons who are having money and muscle power have the capacity to mould the decision in their favour and unfortunately in such heinous task they get full fledged support from politicians, ministers and administrative bosses. Entire talks of judicial reforms going on in political arena for last two- three decades are nothing but Bakwas and it is politicians who are fully responsible for making mockery of Indian democracy as well as judiciary. Even PM admits the cancer of corruption but fail to eradicate it. President of India prefers to be deaf and dump and think it wise to remain silent spectator of Chirharan of Draupdi (innocent citizen) apparently to respect spirit of the Constitution.

It will not be untrue to say about Indian judicial system, that culprits become very happy when a case is lodged against them in any court. Police may be managed with some difficulty and after heavy payments but courts and even CBI people can be managed comparatively easily and comfortably .Judgments can be manipulated in collusion with advocates or heavy weights comparatively easily and more comfortably. Not only this even ruling political party get rid of public protests and hotshots from angry members of opposition parties once they sanction CBI inquiry or lodge FIR in Thana and lodge case in Indian court against any big criminal act or terror act. After all who is bothered of whether such CBI cases or CBI inquiry eventually proves to be futile exercise.

Delay to stop naxalism will prove disasterous

Politicians are still not unanimous on war against naxalism. People like Digvijay Singh, Lalu Yadav, Mamta Banerjee still playing politics and talking of dialogue with Naxalites or resisting air strike on naxal hideouts. Such politicians always think in term of political advantage in their area of operation, they are least bothered of Indian security or mass killings by naxal groups. Such politicians do not hesitate in taking help from naxalites in winning the election and hence they are not ready to accept naxalites have posed fatal threat to Indian security, they do not agree to the views that naxalites are more dangerous than foreign-based terrorist.

It is unfortunate that even wise, experienced, matured, honest, straight forward, nationalist and talented person like Manmohan Singh, Sonia Gandhi, Rahul Gandhi and Mr. Chidambram , Mr. Pranab Mukherjee are unable to take hard decision as late Indira Gandhi took against Khalistanis in 1984 and carried out Operation Blue Star even at the risk of her personal life and political career. It is astonishing that ruling party at center putting blame on state government. One laughs and weeps when Central Minister speaks that Maoist are active in only states where UPA is not in power or where BJP is in power. Indirectly they aspire to belittle and blame state government. Days are not far when opposition parties will speak that ruling party at center is working in nexus with Maoists to disturb non UPA government. In this mutual blame game Maoists are spreading and enhancing their network and fighting power.

Politicians of even opposition camp are not wholeheartedly in support of war against naxalism.There are many sympathizers of Maoists in opposition as well as ruling camp. Even social reformers talk of leniency with Maoist.

It is pity and unfortunate for country like India that self interest of politicians have hijacked national issues and there is acute shortage of true nationalist like Patel, Netaji Subhash Chandra Bose, Mahatma Gandhi or other freedom fighters who forced British rulers to leave India.

Killers of innocent Indians and armed forces. Hijacker of trains, bombers on CRPF camps or on running trains can never be true Indians and hence they are worse than Britishers who were at least not killers as naxalites of present era are. Undoubtedly such killers have to be treated, as enemy of the Nation and sincere war must be launched against network of such killers called as Maoist or Naxalites.

It is very much disheartening to observe that our rulers are busy in fixing quota for woman or for one caste or the other without creating job opportunities. It is ridiculous that our rulers are harping on GDP growth every day and every moment without taking into account the miserable position of 95% of Indian population who are victim of unabated price rise during UPA rule.

Neither Common men are happy nor country as a whole is safe in the hands of such politicians who all the time thinks from the point of view of electoral gain. I am very much fed up of hearing the news related to GDP growth or global recession or India’s so called success story vis a vis other developed nations of the world.

I may simply pray God to give wisdom to rulers of this country so that at least problem of naxalism is handled with full sincerity without fear of electoral loss or gain.

Payment of Gratuity

Now-a-days Engineers and MBAs change the company frequently to get better and better job opportunity and better and better annual package. Attrition rate in most of the private companies is 20% and more. It means every one of five recruited by a company leaves the job of that company in one year to join some other company , either due to better offer or due to uncomfortable work in the existing company or the company removes him due to poor performances.
But in all such cases companies save payment under Gratuity Act because minimum service for payment of gratuity to an employee is five years. In all such cases employees are losers and the employers are gainers. As a matter of the fact there are less than 50 out of 100 employees recruited in a particular company are more than five years old. Advocate should file a PIL or any other case in any court of law to give relief to such job changers.
Gratuity Act is very old and it needs amendment in the present change scenario. Since the private sector employees are not well organized and particularly job changers have no support of any union or political party this anomaly of the law could not come to light. Since the public sector employees are organized and there are very few cases of leaving of job by an employee in less than five years span of time. As such employers in public sector do not get such gain and the loss to employees in government sector is almost insignificant.
I however request highest officer President of India to look into the matter and guide HRD Minister or Finance Minister or the Law Minister to bring out necessary changes in the Gratuity Act to ensure that gratuity is paid to an employee even if he has served for a month or else it should be made transferable like Provident fund. It is worthwhile to mention here that such job changers face a lot of difficulty in taking back even accumulated contribution towards PF account from many newly developed companies and lastly they discard it. Obviously new brand companies are depriving genuine right of employees and there are hardly a few people who seek remedy from Indian courts because legal remedy is more costly and time consuming than the amount involved in such sacrifices. However it is also true that Job seekers who are to make their career excellent do not have time and also cannot afford legal action.

Role of Government of India

Central government cannot escape its responsibility to handle the problems related to naxalism and save he country from the danger posed by naxalite groups, by anti national forces acting from inside the country. They cannot put blame squarely on state governments saying that naxalism is law and order problem and hence a subject of state government. Only fool can accept the theory of law and order problem cited by Ministers in Central Government or leaders of Congress Party or any other person like Lalu Yadav even after experiencing large scale killing of CRPF and common men in last one month only , that too on one place only and that in Dantewara district in Chattisgarh state. This is happening despite the fact that Chief Minister of Chattishgarh is making all efforts to handle naxalism and extending all support to Central government wholeheartedly. In other states like Bihar, West Bengal, Orissa, Andhra Pradesh and Jharkhand mass killing by naxalites has become common feature and hence accepted by common men as usual incident like road accidents. .

Naxalites have grown in number, in financial strength and accumulated huge arms and ammunitions and now they openly challenge and threat state governments, kill CRPF and police personnel in wholesale number, not to speak of thousands of innocents common men. When naxalites are not worried of central Para military forces, how untrained and unequipped police personnel under the control of state government can control and stop naxalism. It is pity that state government are not able to control even traffic jams or stop large scale money extortion carried out by local goonda elements in small or big towns. Digvijay Singh like mad politician can only blame Raman Singh CM of Chattishgarh to do dirty politics, such person should keep in memory naxal like incidents occurring frequently in Kashmir and also Mumbai terror attack of 1991 and incident of unforgettable 27 -11 and many more fatal attacks which occurred in the past when Congress Party was in rule. I do not want enumerate them to waste the time of readers.

I therefore appeal leaders of ruling party not to treat the problem of naxalism from the view of political advantage r disadvantage. Naxalism has penetrated in many states of the country and presently it poses a bigger threat than terrorism managed by foreign based camps. It is no more a hidden fact that Pakistan based terrorists are using India based naxalites to weaken India’s internal security and demoralize the security forces. It is open secret that even police forces are paying dadagiri tax to naxalites for survival in all naxal affected areas and they are even parting with their arms or even selling arms and ammunitions to naxal groups.
If Indian government even now do not understand the gravity and danger of Maoism or naxalism and delay in launching a sincere war against naxalim to finish it for ever and for rooting it out from every corner of the country, India will have to face the same problem as Sri Lanka faced the problem of LTTE . Ultimately Sri Lanka declared war against LTTE and finished it. India will have to do the same sooner or later, though they may do so after incurring huge loses of human beings and facing the worst position of demoralization, demotivtions and division in armed forces as also revolt from police forces. Common men have undoubtedly lost faith in UPA government and many state governments specially those in states like Jharkhand and West Bengal.

It is proper to mention here that late Indira Gandhi was courageous lady to finish Khalistan Movement though belatedly and it was her this act for the safety of people of India that she was assassinated. But she always considered nation and poor people above party she belonged to. Nation is always bigger than Individual. It will not be an exaggeration to say that present team of politicians could never win the battle of freedom because they are least bothered of common men or safety of the country. Lastly I do not hesitate in appealing all state governments and politicians in general to support present Home Minister Sri P Chidambaram wholeheartedly in fighting Naxalism even by using war weapons or using air strikes.

Performance, Posting and Promotion

Now I would like to ask top management as also CBI to look into each actions of executives (scale IV to scale VII) who have been elevated to scale IV and above during last three years during the tenure of present CMD Mr. M V Nair. I hope management will be honest enough to come forward with white paper on these executives depicting their good or bad works of last ten years and prove that the action of Interview panel in giving him or her promotion was justified. Otherwise normal perception of junior officers that promotions are bought by gifting top officers will be substantiated and exposure of top management will take place. At least top 20 branches of Jharkhand or Bihar or UP or Orrisa or West Bengal will be enough to expose the unhealthy culture perpetuated by top officers in promotions, postings and transfers. Bank must ascertain profit earned or loss incurred by the actions of officers promoted to scale IV and above during last three years.

1.credit decision taken by promoted executives and the present status of these advance accounts .If the credit sanctioned or disbursed by them directly or indirectly (building pressure from administrative office on BM) above Rs 10.00 lacs has become bad ( though bad , concealed and categorized as standard in collusion with top management), reason behind it should be looked into.
2. Number of accounts and amount involved in those NPA accounts where sanction or disbursement made by such executives during last ten years.
3. Waiver of loan or sacrifice of bank's dues under compromise settlement sanctioned by them directly or through the Branch.
4. How many good accounts they have added during their posting at any branch. Good account means average balance more than one lacs. How many such good customer left the bank due to the misbehavior of BM. Overall analysis will tell about level of customer service extended by them. This will also tell the management whether they are really good officers or they were promoted after taking some gifts in cash or in kind by Interview panel officers.
5. How many bad accounts have been shown as standard in the branch but they are actually substandard.
6. It should be looked into whether there was any abrupt rise in deposits due to buying of government fund. If yes wherefrom the illegal money was managed.
7. Real cash recovery in bad accounts due to the efforts of promoted officers
8. Whether there is real positive change in the image of the bank in the area where they worked.
9. Whether the so called performance said to have been of the promoted officers was actually the performance of other honest and devoted workers
10 Whether malady created by / fraud committed by / bad advance generated by flatter officers war getting support from higher bosses due to some other hidden reason which cannot be revealed.

Naxalism is new Awtar of Ravana

This refers to today’s news that Maoist have offered compensation to aggrieved families of CRPF jawans killed by them at Dantewara in the state of Chattishgarh on the memorable and unforgettable day 6th April 2010
.
This is the fittest reply given by Maoist to inefficient, corrupt and non performing government. Hitherto government used to announce compensation for poor and innocent killed in any mishap, terror attack or naxal attacks where government was guilty of ineffectiveness, inertness and corrupt administrative system.

Instead of improving the quality of administration or punishing the guilty persons sitting in government offices, our ministers used to sit calm by announcing some compensatory packages or relief and rehabilitation after each naxal or terror attacks and brutal killing of innocent villagers.
.
For the first time, Maoists have announced the same compensation for family members of victim families of 76 CRPF men killed by themselves. This is indeed a cruel joke on our government and should now at least open the eye of sleeping government and of at least those social reformers or politicians who advocate for dialogue with naxal elements.

Now it may be clear to government that Maoist has grown more powerful than government in financial as well as fighting capacity. Government should be ashamed and keep their head low now or else leave no stone unturned to fight to finish Maoists without listening to any demand for dialogue with those who do not respect Indian laws and Indian citizen.

Fight for image of government

Problem of Naxalism and extremism is increasing year after year. Government in last three decades has almost underestimated the gravity of the matter ad neglected the same altogether. There have been fatal attacks by naxalites in their area of operation on many occasions in the past but no substantial action has been taken against the attackers.

Police force in each state knows how naxalites are extorting money from rich businessmen, house builders, service men and even police personnel. Many police stations have been attacked in the past and their guns and other arms and ammunitions have been taken away by attackers. Hundreds of innocents have been killed brutally in group. And so on…

Naxalites are growing in numbers and strength year after year. Their Finacial power has assumed the dangerous proportion, they have accumulated huge arms and ammunition and are capable to strike even CRPF camps and kill them in good numbers as happened on black Monday saddest 6th April 2010 in Indian history. They have exhibited their power of strike on many occasions in the past. But unfortunately politicians in our country never tried to stop the same.

There are still many politicians who are sympathizer of such naxalites, who take the support of these hard core naxalites during election to give a befitting reply to their opponents, who use gang members of naxal groups to motivate and threat voters and force them to cast their valued votes in favour of desired candidate or face the dire consequences. It will not be exaggeration to say that members of naxalite groups are sitting in all offices from state level assemblies to village level panchayats and block level government offices to state secretariats.

Members of naxal groups have not only spread their network to a great extent but actively working in each corner of the country. Every big or small contractor working for various departments of the government has to donate money in proportion to their contract value to Naxalite groups. For common men it is called as dadagiri tax. People have accepted this dirty system and do not approach police or any office to get rid of this extortion, because of non action or because of more dangerous consequences.

It is unfortunate that during last three decades government remained almost silent spectators of all such dangerous activities of naxalism. After each fatal attack by naxal groups, Home Minister like Mr. Shiv Raj Patil thought it wise to announce some monetary help for the family of victim of naxal attacks and thought it better and beneficial not to take any step to stop spread of naxalism in the country like cancer.

It is also a bitter truth that even ruling government and police forces are also afraid of repercussions on their family or on the their election prospects from naxal groups,.

Many nationalist, writers, social activists and honest politicians have pointed out that naxalism is greater threat to India than external threat from country like Pakistan or global terrorism. But the valued suggestions of noble writers were always ignored. As a result of this prolonged negligence and casual approach of various governments naxalism has become greatest threat to people of India.

It is only in the last year that Mr. P Chidambram took charge of Home department and started his sincere work against terrorism coming from abroad as also against naxalism in the name of Operation Red Hunt. There is no doubt that he has created a fear in the mind of naxal groups and this is why they are trying to belittle the effort of the government .I have no doubt that Mr. Chidambaram has the will and the brain to combat naxalism and terrorism tooth and nail and it is he who can finish the same from the root provided he gets wholehearted support not only from his party members but also from members of opposition groups,

Mr. Home Minister needs support not only from central and concerned state governments but also from local people who can play prominent and vital role in identification of naxalites, trained criminals and tell about their hide outs, their action plan etc.

It is the urgent task before government to leave no stone unturned to finish naxalism from the country. Government should not give opportunity to Pakistan in particular and international community in general to say that India is incapable to control even domestic terrorism.

Role of Media condemned by Dr. Abdul Kalam

Is Female dominated by male in Indian society?

The society is dominated by money power and muscle power and not by male, might is right. Everyone worship who is powerful, gender is irrelevant. In the state of Tamilnadu Jayalalitha is worshipped like goddess. Mayawati is treated as Devi in UP. Indira was treated as India. Even Sonia is followed like Devi. Many Congress leaders are ready to touch her feet to get some good post, respectable birth in cabinet, get a ticket for election etc. Every male member loves his sister, wife, and mother more than his brother, father or anyone else. In many offices lady worker has played effective role. Bank like ICICI is headed by lady Kochar. Indian bank was headed by lady chairman who changed the fate of Indian bank. I therefore do not agree with the saying that lady in India is dominated by male member. There are several males who do not work, who are addict of bad habits, and who are totally incompetent try to dominate forcefully on female .they are few. It will not be an exaggeration if one say that in practice and in real life of a good family, male are dominated by female, not due to any pressure but due to mutual love and respect.

Why Indian depends on USA for all matters related to Pakistan? Can Indian alone not tackle Pakistan?.

This is the great weakness of Indian diplomacy. In the past India used to blindly support USSR and now blindly follow USA. Inspite of all India's image is good in International arena. Even USA considers India as a probable threat in future. USA uses Pakistan as a tool to weaken India to maintain dominance of USA. However India has built the capacity to teach Pakistan lesson and damage it if needed. But in war, loss occurs to both parties. Even Pakistan has developed substantial energy to spoil many parts of India. As such war is enemy of human being, causes loss to warring countries, more or less it may be, loss is loss. All efforts are therefore by peace loving country India to resolve the issue with dialogue or with pressure from super powers of the world as we all peace loving people in India use to do to resolve family or social disputes through dialogue and through intervention of some effective person of the area. . Indian people always condemn terrorism and naxalism. All religions advise for love and mutual respect.

Why people do not revolt against corruption?

There is no revolt against corrupt system because most of the people are corrupt. All are sitting in glass house. Who can dare throwing stone on others? Number of person not accepting or giving illegal money, gifts and favour of any kind are very limited and hence not powerful and not that much effective which can produce a wave of revolt against rampant corruption in the system. India needs person like Gandhi who shook the castle of British rule and gave India freedom. Jai Prakash Narayan tried to punish the corrupt public representative but failed to stop greedy followers who punctured his movement to serve their vested self interest. India needs person like Netaji Subhash Bose or Sardar Ballabh Bhai Patel. We have Manmohan and microscopically few other simple people full of honesty who follows Lady Sonia to safeguard his post or who prefer remaining a silent spectator of rape of democracy and prevalent corruption in Indian system. As such people have more or less accepted corrupt practices as normal practices. .




What should an employee do when he or she is harassed by his boss or CEO?

Days are gone when labour laws were respected by government. Now-a-days even labour offices, government departments, banks, insurance companies and all private companies are indulged in labour exploitation of labour. There is none to raise voice against it in the name of reformation. In near future we will reincarnation of socialism in some other name. Capitalism cannot last long. Gap between rich and poor is widening and as a result crime graph is going up and up, riches are indulged in profit making and hence price are going up and up. Ministers and officers, babus and even peons are indulged in earning illegal money. There is none to raise a voice against boss or CEO of any company who are forcing employees to work more than twelve hours a day and who have almost made the family life of employees miserable. Even if some voices are raised here and there, such people are isolated and shunted in critical and remote areas or removed from service. As such most of good workers have to lead a life in rejection, dejection, depression, frustration etc.

Why is the media here so negative?

Why are we in India so embarrassed to recognize our own strengths, our achievements?

I was in Tel Aviv once and I was reading the Israeli newspaper. It was the day after a lot of attacks and bombardments and deaths had taken place. The Hamas had struck. But the front page of the newspaper had the picture of a Jewish gentleman who in five years had transformed his desert into an orchid and a granary. It was this inspiring picture that everyone woke up to. The gory details of killings, bombardments, deaths, were inside in the newspaper, buried among other news.




In India we only read about death, sickness, terrorism, crime. Why are we so NEGATIVE? Another question: Why are we, as a nation so obsessed with foreign things? We want foreign T.Vs, we want foreign shirts. We want foreign technology.
Why this obsession with everything imported. Do we not realize that self-respect comes with self-reliance? I was in Hyderabad giving this lecture, when a 14 year old girl asked me for my autograph. I asked her what her goal in life is.
She replied: I want to live in a developed India. For her, you and I will have to build this developed India. You must proclaim. India is not an under-developed nation; it is a highly developed nation.

He's right. We go to the polls to choose a government and after that forfeit all responsibility.

We sit back wanting to be pampered and expect the government to do everything for us whilst our contribution is totally negative.
We expect the government to clean up but we are not going to stop chucking garbage all over the place nor are we going to stop to pick a up a stray piece of paper and throw it in the bin.
We expect the railways to provide clean bathrooms but we are not going to learn the proper use of bathrooms.

We want Indian Airlines and Air India to provide the best of food and toiletries but we are not going to stop pilfering at the least opportunity.

This applies even to the staffs who are known not to pass on the service to the public.
When it comes to burning social issues like those related to women, dowry, girl child! and others, we make loud drawing room protestations and continue to do the reverse at home. Our excuse?

'It's the whole system which has to change, how will it matter if I alone forego my sons' rights to a dowry.' So who's going to change the system?

What does a system consist of?
Very conveniently for us it consists of our neighbors, other households, other cities, other communities and the government. But definitely not me and YOU. When it comes to us actually making a positive contribution to the system we lock ourselves along with our families into a safe cocoon and look into the distance at countries far away and wait for a Mr.Clean to come along & work miracles for us with a majestic sweep of his hand or we leave the country and run away.

Like lazy cowards hounded by our fears we run to America to bask in their glory and praise their system. When New York becomes insecure we run to England. When England experiences unemployment, we take the next flight out to the Gulf. When the Gulf is war struck, we demand to be rescued and brought home by the Indian government. Everybody is out to abuse and rape the country. Nobody thinks of feeding the system. Our conscience is mortgaged to money.

Politics of flattery

Congress party is a party of flatterers and hence even UPA ( ruling party) headed by Congress party is dominated by those who flatterer the high command and follow her by hook or by crook, even if it is needed to humiliate the person of high repute such as Abhitabh Bachhan. They want Shahrukh Khan, Salman Khan, and Amir Khan to popularize Congress party candidates and enhance their winability in election. Congress Party leaders do not believe in doing work for the area where people voted them to power. Congress party leaders desire to win sympathy of Muslims by removing photo, banner, video audio clips of even Abhishek Bachhan from a function in Delhi organized under the banner of WWF under the chairmanship of Delhi CM Sheila Dikchit.

Traditionally it is observed that none in Congress party could ever dare of going against High command in congress Party. This is why Chief Minister of Maharashtra thought it better and beneficial to humiliate even International fame icon Abhitabh Bachhan just to please Sonia. Leaders of Congress party do not hesitate in speaking white lie just to obey the order of high command, right or wrong it may be. Survival of congress party itself depends not on its performance but its opposition to BJP and favour to those who support Muslim line. Abhitabh on the other hand accepted offer of Gujarat CM to become brand ambassador of Tourism in the state of Gujarat. It is not digestible for Congress High Command.

In congress party, none is really interested for image of the country. They therefore do not hesitate to give Bharat Ratna award to disputed figure, Padam Bibhusan award to film hero of lesser fame and lesser popularity etc. Even promotions and posting of IAS and IPS officers, judges, Chairman of various departments and PSUs depends on their degree of flattery to ministers and high command, ant not at all on their merit , talent or performance in their area of operation.

Our country in brief is a country of yes-men and flatterers, not performers.

Act of Sri Sri Ashok Chauhan CM of Maharashtra or that of Shiela Dikchit CM of Delhi is not isolated examples of backtracking from their own stand to please the High Command. There are several such examples of Congress leaders blindly toeing the idea of High Command. It was Congress leader who had told “Indira is India” Image of Abhitabh or that of Abhishek is glorified and cannot be tarnished or blackened or shadowed by flatterer like Ashok Chauhan or Shiela Dikchit or any media sycophants of Congress Party High Command.

Budget for common men or for riches

Price Rise:::::::

With the rise of petrol and diesel prices there will be rise in bus fare, freight fare by trucks and indirectly prices of all commodities will rise due to rise in transportation cost. It is also true that when petrol or diesel prices go down there is no fall in prices. When ATS fuel prices rise airlines raises airfare but do not reduce the same when ATS cost comes down. Prices can be controlled only by conducting raids on traders, manufacturers and commodity brokers who are artificially raising prices.

There is no shortage of production and it is told by government many times and it is also known that government is proud of GDP growth in the country. Regulation of prices of all goods and services need to be done at all level but in the name of reformation administration is ignoring the same and has given full freedom to businessmen to earn maximum profit. http://in.linkedin.com/in/danendra

Subsidy:::::::::

Subsidies of all types are looted by fabricating relevant documents. It may be NREGA money or Industrial subsidy or fuel subsidy or fertilizer subsidy or export subsidy or subsidy under various loan schemes sponsored by government of India. There is large scale loot going on in one name or the other. When media traps one scheme they change the name and old wine in new bottle continues. Income Tax relief:::::::::::::::::::

There is nothing substantial in budget other than a little bit compensatory relief ( price rise is almost 100% during last one year and when prices rises there is salary erosion at all levels. Even businessmen whose income is less than five lacs faced the pain of price rise)to salaried class people or person having income upto 8 lacs.

Large part of population constituting 80% of Indians who are having less than one lac as annual income will not get any relief but they will be forced to share burden likely to rise due to rise in fuel prices. Housing Sector::::::::::::

1% interest concession has been allowed to those who avail loan upto Rs.10.00 lacs but service tax has been imposed at 10% on builders who take advance for booking a flat.. former will give a little bit relief but there will be at least ten times of this relief as rise in cost of flat.

Private companies have been allowed to set up local private banks in all towns and villages. Now these banks will exploit rural people as money lenders used to exploit them before nationalization of banks. On the one hand government is talking of consolidation of banks and on the other they do not hesitate in giving more and more licenses for private banks.

Even existing NBFC are beyond the control of the government and every year some NBFC close their offices and found to be absconding when poor and innocent depositors ask for payment as promised by them. Now government is trying to add fuel to fire by giving them permission to establish local banks.

Talk and talk only

It is absolutely right that Government of India is seeking excuses in foreign land for terror attack or for racial attack. Government has been blaming others for its own weaknesses, inefficiency and inactiveness as also for rampant corruption. Terrorists are active in one form or the other in our own country and in every corner of the country. It will not be an exaggeration if I say that in every mohallah in every town there are few terrorists who exploit innocent and helpless citizen, student, traders, servicemen, land owners, professionals, car owners, cr parkers, hawkers, and others in one way of other. Naxalites are the visible Indian version of terrorism. Police terror is another version of terrorism. Corruption in administrative machinery and judicial system is third version of Indian brand of terrorism. Several task force committees have been set up for bringing about reformation in the system but all failed to yield result. For last three decades one after other efforts has been made to have dialogue with terrorists or naxalites but no solution has come.
Each government passes time and prepare for next election. Who is bothered for the security of common men or for the security of the country? Prices of all essential commodities are increasing and increasing, media is shouting and shouting but PM and president of India or all ministers are enjoying their life peacefully. They are awakened only by strike, mass rampage, arsoning and attacks like terror attack. Even if they are awakened they are likely to go for sleep again in a few days after lodging a inquiry commission or setting up a task force committee to look into the unhappy incident.
Thousands of letters and emails are sent by aggrieved person or loyal citizen of the country to important dignitaries to highlight irregularities and corrupt practice prevailing in the system, but unfortunately all such letters and emails are filed, not acted upon and not responded. I am unable to visualize any solution for any problem, it may be terrorism or price rise or rising unemployment and poverty.
If properties of these ministers and MPs are confiscated and they are booked to jail for their failure and for their inefficiency I think all rush for seeking ticket for election will end. If delegated powers of MPs and Ministers is narrowed down and transparency is established in all their actions, power of transfer and posting and promotions is completely abolished I hope flattery culture will end and officers in general will work sincerely and not indulge in yesmanism..

Budget 2010-11

I am not an economist, nor an expert in finance management of the government. I however try to project my feelings. Liquidity crisis or Sub Prime Crisis occurred in USA and other European countries. How did it affect Indian economy in the year 2008 which forced Indian Government to sanction stimulus package in line with what Obama did in USA.

Is it true that export proceeds of goods exported to USA or any other countries were stopped by importing countries?

If not how did it result in liquidity crisis? When foreign countries stops import , real problem may arise in selling exportable goods in domestic market.

If export proceeds were really stopped by importing nations like USA, government could have been justified in sanctioning financial package for such affected exporters or manufacturers, but not justified in allowing benefit to all.

CRR and SLR were reduced to release liquidity for banks. Is it justified to provide such liquidity (interest free fund) to all banks whether they were associated with affected exporters or manufacturers or not?

Even if it is considered that release of liquidity or relaxation in tax in general without discriminating the real victim of said sub prime crisis of USA was justified, the matter of vital concern is whether government has ensured that affected units have actually benefited in any way from the said stimulus package.

Has government ensured that domestic demand of exportable goods has been created to compensate loss caused due to stoppage of exports?

If domestic demand has not increased, how the said affects units have utilized the stimulus package and how they could maintain the same turnover as they used to exhibit through export proceeds?

Has government tried to ascertain the proportion of stimulus package released for banks used for growth of manufacturing or export sector and what proportion invested in MF or parked in RBI at Repo rate to earn interest or dividend?

Is it not true that excess of fund provided to business units, traders, manufacturers and exporters resulted in huge hoarding, black-marketing and abnormal profit making?

If it is true, government should admit that the current price rise is nothing but the making of the government.

Income of poor people did not rise but prices showed relentless rise and this resulted in considerable erosion in purchasing capacity of poor and middleclass families. As a result demand of the consumer goods at grass root level has sharply come down.

Had the government avoided stimulus package, the exportable goods could have come in the domestic price at reasonable price and demand could have gone up to a considerable height and the end result could have given a boost to manufacturers and traders.

Further the government could have used the fund released through stimulus package in carrying out additional public investment to create additional demand and additional employment opportunities.

If there is a little bit relevance in points raised by me I think government should not hesitate in withdrawing stimulus package in gradual and comfortable manner. This will help in combating inflation and ease the burden of poor to a good extent.

If liquidity from banks is withdrawn, banks will not invest in MF, will not park surplus fund in RBI to earn interest at repo rate and at least not opt for sub-PLR lending to corporate or to real estate sector which benefits none other than upper class of the society.

Banks will be forced to mobilize deposit at some higher rate which will benefit poor and middle class families and pensioners to a greater extent. If lending rate to corporate goes a little bit higher, if rate for housing loan or loan for car goes higher I am very much confident and the experience of pre-reformation era reaffirms my belief that sale of these luxurious goods will not come down and neither nay corporate sector will stop their activities on account of little rise in borrowing rates.

Can I conclude now that the fear of global recession in India was artificial and maintenance of growth rate achieved by dint of the said stimulus package is also imaginary, unreal and willful exaggerated to hide the faulty policy and faulty execution of government’s good policies?

Ministry of Home

India is a vast country and Indian security forces or police cannot provide security to all people in each corner of the country. This is a bitter truth, which every Indian must admit. We are fortunate enough that terrorists are active and conducting terror attacks in metros and big towns only. If they start targeting small towns, cities and village for target attack, I apprehend India’s security arrangement will get punctured and prove to be hollow, absolutely incompetent and inadequate to deal with highly equipped, trained and funded terrorists.

I feel however proud that person like Mr. P Chidambaram has been in charge of Home Ministry and he has left no stone unturned to have best control and best use of available police and armed forces, to monitor and coordinate various intelligence agencies and to have best possible liasoning with most of the concerned department to achieve best possible result in available resources, at least far better than his immediate predecessor Mr. Shiv Raj Patil. It is his sincere efforts that during last 400 days no terror attack took place and many probable attacks were thwarted and culprits were booked in jail.

In the present case of Pune blast also, home ministry had alerted all well in advance about probable terror attack. Police forces as also people of these towns were cautioned to be alert of terrorists and unidentified bags. But home ministry or the police forces cannot follow those terrorists 24 hours 365 days. . Terrorists on the other hand are behind their target 24 hours and 365 days. This mismatch gives terrorist an opportunity to befool public as well as police. If people of India, politicians and media all cooperate, I hope India will be safer. Government needs to send a clear signal to criminals that there will be no sympathy for those who commit crime and violate laws of the Nation, irrespective of their caste or community and needs to ensure quickest punishment to crime perpetuators, even if it needs to jail Thakre like person or Indian Muzahiddin (IM) needs to be banned and its members need to be booked to task.

We therefore need a fool proof system which can take care of common men at all places every minute, every time. Police forces and the ruling party succeeded in release of MNIK in Mumbai and in the state of Maharashtra only because it was a few days phenomenon and one time event. Police forces were sent in civil dresses in all cinema halls to control the situation successfully. Similarly Indian government has to ensure that fifty percent of police forces are posted in civil dresses and made active in all corners of the country to guard common men to watch on the malicious activities of terror groups or naxal groups. This is possible only when entire political system and administrative machinery is redefined, reactivated, revitalized and rejuvenated. And the most important is that politicians are kept completely away from police forces. This is possible only when politicians discard vote bank politics and give value to security of Indians on priority.

However this is also true that police force in our country do not work sincerely and honestly at all the places and in all the states in the country. Reason behind inactiveness of police force is also nothing but wrong policies and wrong treatment of police force in the hands of politicians. When they act some party or the other abuses them, when they do not act they are abused by some politician or the other. It is therefore easy and comfortable for police personnel to do what politicians or ministers in person like them to do. It means police forces in general think it wise, prudent and better to flatter VIP and powerful person to get cream posting, easy promotions in career and get rid of all charges leveled against them by common men. We need to change this culture prevailing in almost all government offices, banks and insurance companies.

Unfortunately in our country those who act honestly and sincerely are more often than not shunted out and placed at such a critical place that honestly becomes a curse for its followers instead of an award. Even distributing of various medals or awards for successful completion of any task or any courageous action in police forces are based on either flattery to bosses or recommendations of some higher authority or some political heavyweights. Prestigious award like Padma Bhusan, Padam Shree, or Padam Bibhusan are awarded to controversial figures. This is very much painful.

Indians know how sincere IPS officer like various governments in her career treated Kiran Bedi when she was in job. People know how person like DGP Mr.Rathore got one after other promotions and better posting even after his involvement in Ruchika’s case. In the past few days IAS officers have been found to be indulged in large scale corruption and property worth many crores of rupees have been caught by IT authorities. Morality of top officers has faced dangerous erosion in the hand of politicians of the country.

Obviously entire set of administration has become victim of corruption and selfish policies of politicians. It is ironical that politicians who are originator of all corruption always blame administration for rampant corruption. This mutual blame game continues and common men become victim in all the cases of security lapses and it is painful that in this mutual mud slinging process, criminals get rid of charges, or court proceedings are delayed and ultimately criminals get rid of punishment for their crime. As a consequence crime graph in our country is rising unabated.

To add fuel to fire, criminals are getting support of various political parties to enter in to Parliament and take part in debate and stop legislative or executive action against criminals. It is undeniably true for Indian political system that politicians and criminal are two sides of the same coin and police forces are instrumental to them, subsidiary to them and nothing but extended arm of our bad political and administrative system .We therefore need thorough change in the system from top to bottom level.

It is also regrettable that even media instead of focusing main problem, concentrating on terror attack and searching its possible remedy start searching loopholes in the speeches of ministers, police authorities and change the agenda of the country from security mechanism to dirty political game. Media portrays the picture of terror attack in a way, which is not conducive for proper and appropriate investigation of the terror attack. Even intelligence inputs are broadcasted and elaborately enlightened on TV in such a way which help more to terrorists in changing their target and strategy, rather than helping police and people of the country to effectively trap the terrorists before they act upon their conspiracy to destabilize the country. Enemy foreign countries take advantage of our weak points and always succeed in execution of their dirty, destructive and divisive plans to weaken India. Undoubtedly media needs to be made accountable and responsible towards sensitive issues like terror linked in formations and post terror attack investigation procedures.
